Open tuning & shortcut capo

What kind of capo is he using that he can play behind it like that? I know that he doesn't have the capo on the two highest strings. He seems to be playing behind it on the lowest string.
 
I use a home built short capo for a few tunes. I just cut an 1/2 inch or so off a regular kyser. It enables me to get to an alternate tuning, w/o actually retuning and some chords are fretted the same. I also use a drop d tuning with the short capo on a few tunes. This gives you a modified double drop D, but again, the finger patterns stay the same.

I've said more than once, this is trickery and deception trying to mask my lack of ability.

I've got a hard enough time figuring out alternate tunings without a partial capo. My brain hurt listening to his explanation.
 
You can cut out whatever bits of a Kyser capo you want to allow open strings. Easier than playing one of these.
